1. Seller Information

This e-commerce site is operated via the Shopify platform.

The seller is solely responsible for creating the graphics and managing the site.

Products are printed and shipped by third-party print-on-demand providers, specifically Gelato.

By placing an order on the site, the customer fully accepts these Terms and Conditions.

2. Customized products

The products for sale are customized and made to order.

  • The images on the site are digital previews.
  • The final result may exhibit slight variations in color, size, or positioning.
  • Once the order is confirmed, the graphics cannot be modified.

3. Conclusion of the contract

The sales contract is considered concluded upon confirmation of the order and payment.

After confirmation:

  • the order is automatically sent to the supplier for production
  • it is not possible to cancel or modify the order

4. Prices and payments

Prices are shown in euros (€) and include applicable taxes, unless otherwise indicated.

Payments are processed through the secure systems provided by Shopify.

5. Production and shipping

Product production and shipping are handled exclusively by the third-party supplier.
Production and delivery times are estimated.
Any delays due to couriers, customs, or force majeure are not attributable to the seller.

6. Right of withdrawal

Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply to customized products.

Since these are custom-made items:

  • ❌ returns are not possible due to a change of mind
  • ❌ order cancellations are not possible after confirmation

7. Returns, refunds and exchanges

Returns or refunds are accepted only in the following cases:

  • defective product
  • printing error
  • product damaged during transport

Procedure:

After verification, the seller may offer:

  • a reprint
  • a replacement
  • a refund

❌ Claims are not accepted for:

  • design errors approved by the customer
  • slight color differences
  • incorrect size selected by the customer

8. Limitation of liability

The Positive Roar is not responsible for:

  • defects attributable to the supplier's manufacturing process
  • shipping delays
  • improper use of the product

In any case, liability is limited to the value of the order placed.

9. Intellectual property

All graphics on the site are the property of The Positive Roar di Vinerba Gian Marco.

Unauthorized reproduction, distribution, or use is prohibited.
Customers who provide their own content guarantee that they hold the rights to use it.

10. Applicable law

These Terms and Conditions are governed by Italian law.
Any disputes will be subject to the consumer's jurisdiction, if applicable.
